This document outlines the risks, responsibilities, and community standards you agree to by participating in Backcountry Beauties / Backcountry Bonds events. Please read carefully before proceeding.
I, the undersigned participant, hereby acknowledge and agree to the following terms as a condition of my participation in meetups organized by Backcountry Beauties or Backcountry Bonds (hereafter referred to as the “Community”):
Activities & Risks: I understand that participating in community meetups involves various activities, including but not limited to backcountry skiing, snowboarding, hiking, mountaineering, backpacking, biking, community meetups, powersports, bikepacking, boating, camping, watersports, canyoneering, climbing, fishing, air sports, hot springs, martial arts, motorcycles/dirt bikes, foraging, off-roading, racing, reading, rockhounding, running, skateboarding, snowmobiling, van/camper life, yoga, parties, and other social or recreational events. These activities may be inherently dangerous and carry a significant risk of physical injury, property damage, and even death. Risks may include, but are not limited to, avalanches, falls, collisions with natural and man-made objects, difficult weather and terrain conditions, equipment failure, navigation errors, and risks associated with group dynamics or alcohol consumption at social gatherings.
Equipment and Preparation: I acknowledge that it is my sole responsibility to provide personal equipment necessary for participation in outdoor events, such as a beacon, shovel, probe, helmet, and any other required gear. I affirm that my equipment is in good working condition and that I have the necessary skills and knowledge to use it safely. For social or recreational events, I understand that I am responsible for ensuring my own safety and well-being.
Assumption of Risk: I willingly and knowingly assume all risks associated with participation in the Community’s meetups and events, both known and unknown, even if arising from the negligence of the Community, its organizers, members, or others participating.
Release & Waiver: I hereby release, waive, discharge, and covenant not to sue the Community, its officers, members, volunteers, participants, and agents (collectively, the “Releasees”) from any and all liability, claims, demands, actions, and causes of action whatsoever arising out of or related to any loss, damage, injury (including death) that may be sustained by me, or to any property belonging to me, while participating in or preparing for the Community’s meetups or events, whether caused by the negligence of the Releasees or otherwise.
Indemnification: I agree to indemnify and hold harmless the Releasees from any loss, liability, damage, or costs they may incur due to my participation in the meetups or events, whether caused by my negligence or otherwise.
Right to Legal Fees: Should I violate this waiver by initiating any legal action against the Releasees, I agree to be responsible for any legal costs, including but not limited to attorneys’ fees, court costs, and other expenses incurred by the Releasees in defending such actions, regardless of the outcome.
Acknowledgment of Policy: I understand and agree that this waiver and release is intended to be as broad and inclusive as permitted by the laws of the jurisdiction in which the meetups or events take place, and that if any portion thereof is held invalid, the remainder will continue in full legal force and effect.
Emergency Medical Treatment: I hereby consent to receive medical treatment deemed necessary in the event of injury, accident, and/or illness during any meetup or event. I understand that I am responsible for any expenses related to such treatment.
Photography & Filming: I understand that during meetups or events, I may be photographed or filmed. I agree to allow my photo, video, or film likeness to be used for any legitimate purpose by the Community.
Medical Fitness & Disclosure: I affirm that I am medically and physically fit to participate in the activities organized by Backcountry Beauties / Backcountry Bonds. I have disclosed any relevant medical conditions, limitations, or disabilities to the community that may affect my ability to participate safely in these activities. I understand that it is my responsibility to consult with a physician if I have any medical concerns prior to participating in any event.
Personal Responsibility for Training: I confirm that I possess the necessary training, skills, and physical condition required for safe participation in outdoor activities. This includes, but is not limited to, proficiency in navigation, first aid, and the use of specific equipment required for each outdoor activity. For social and recreational events, I am responsible for ensuring my own well-being and contributing to a positive group dynamic.
COVID-19 and Infectious Disease Awareness and Assumption of Risk: I understand the risks of exposure to COVID-19 and other infectious diseases and agree to follow all public health guidelines and community policies related to disease prevention while participating in activities. I hereby release Backcountry Beauties / Backcountry Bonds from any liability should I contract an infectious disease before, during, or after participation in an activity.
Data Privacy Statement: I acknowledge that the Community may collect personal information, including photographs and video recordings, during activities for administrative purposes and promotional use. I consent to the use of my image and personal information for these purposes and understand that my data will be protected and used in accordance with the privacy policy and relevant data protection laws.
Code of Conduct: By participating in events organized by Backcountry Beauties / Backcountry Bonds, I agree to the following standards of conduct, which reflect our commitment to a safe, inclusive, and supportive community:
- Personal Responsibility:
- I will prepare for and participate fully in all events, whether outdoor or social.
- I will take responsibility for my own equipment, training, and preparedness for all outdoor events.
- I will contribute to the success of both outdoor and social events by engaging in decision-making and helping the group as needed.
- Community Respect:
- I will respect, encourage, and support all members of the community as they develop their skills or participate in events.
- I will maintain a positive and respectful attitude toward others, upholding an inclusive environment where everyone feels welcome and valued.
- Environmental Stewardship:
- I will respect Leave No Trace principles during outdoor events, protect wildlife, and take actions to minimize the impact of our activities on the environment.
- Event Participation:
- I understand that all participants are co-creators in both outdoor and social events. Whether it’s monitoring weather or reminding others to hydrate outdoors, or helping organize logistics at social events, I will actively contribute to the success of the event.
- Adaptive Planning:
- I will remain flexible and adaptive to changing conditions and group decisions during outdoor events, recognizing that such environments require continual evaluation of risks.
Dispute Resolution: I agree that any disputes arising from participation in events or activities organized by Backcountry Beauties / Backcountry Bonds will be governed by the laws of the State of Colorado and that any legal action will be brought exclusively in Colorado.
Alcohol and Substance Use: I understand that certain social events may involve the consumption of alcohol. I acknowledge that if I consume alcohol or any other substances, I do so at my own risk. I assume full responsibility for my actions, and I release the Community from any liability for accidents, injuries, or other issues that may arise from my use of alcohol or substances during or after the event.
Transportation Liability: I understand that if I choose to travel to or from events with other participants, either in private vehicles or arranged carpools, I do so at my own risk. I acknowledge that the Community is not responsible for any injuries or accidents that occur during travel to or from an event.
Weather Conditions: I understand that weather conditions may change rapidly during outdoor activities and that I am responsible for assessing the risks associated with weather. I agree to be prepared for adverse weather conditions and accept full responsibility for my safety during events in which weather may be a factor.
Volunteer and Event Organizer Clause: I understand that the event organizers and volunteers are not professional guides or instructors (unless otherwise noted) and that their roles are primarily administrative. I acknowledge that these individuals may not have specific safety training and that it is my responsibility to participate safely.
Severability: If any provision of this waiver is found to be invalid or unenforceable by a court of competent jurisdiction, the invalidity of such provision shall not affect the remaining provisions, which will continue in full force and effect.
Acknowledgment of Understanding
Thank you for agreeing to the terms of the Liability Waiver and Release Agreement. By continuing, you acknowledge that:
- You have thoroughly read the waiver and had the opportunity to ask questions, with any questions answered to your satisfaction.
- You understand and accept the risks involved in participating in activities facilitated by Backcountry Beauties / Backcountry Bonds, including events organized through community connections.
- Your agreement was given freely, voluntarily, and without any inducement, duress, or coercion.
- You are of legal age and fully aware that agreeing to the waiver means waiving certain legal rights, including the right to sue.
By proceeding, you confirm your understanding and acceptance of these terms.
Electronic Signature Clause
By electronically signing or acknowledging this agreement, I confirm that I have read, understood, and agree to all the terms and conditions outlined in this Liability Waiver and Release Agreement. I acknowledge that this electronic signature has the same legal effect as a handwritten signature, and I voluntarily enter into this agreement in full recognition of the risks and responsibilities outlined above.
I understand that by signing this document electronically, I am bound by the terms of this waiver and release, including but not limited to the assumption of risk, release of liability, and indemnification provisions. This electronic signature will be deemed to be my signature for the purposes of this agreement, and it will be treated as a legally binding document in accordance with applicable law.
